Thank you for your interest in Milk Bar’s product survey. You have been asked to participate in this survey based on your recent receipt of Milk Bar’s brand new crunchy cookies in the Brown Butter Chocolate Chip Flavor in your First Bite Club: Delivered box delivered in January 2023.
By participating in Milk Bar’s survey and product test, you agree as follows:
You acknowledge that you are fully aware that feedback, suggestions and/or ideas submitted to Milk Bar by you are submitted on a non-confidential basis and Milk Bar may use or disclose such feedback, suggestions and/or ideas. By submitting your survey responses, you grant Milk Bar permission to use all or any part of the text of your product reviews for promotional purposes in any media, including its website, social media, and advertising, perpetually and worldwide. You understand that your review will be attributed to your first name and last initial, and you release any rights to compensation for its use and for any other feedback, suggestions or ideas provided by you. Milk Bar may use information gathered in the survey to further refine its products or for any other purpose.
You agree not to take any action that could damage Milk Bar’s reputation such as sharing negative sentiments on social media.
You understand that product information is being provided to you on a confidential basis. You agree not to disclose any aspect of the products to others and you will not allow others to analyze or inspect the products in any way. Since the products are still under research and development, we do not want them examined by others and we expect that you will keep all product information and features in confidence.
In consideration for your time in testing our products and completing the requested survey, you will receive 20% off on orders $75+ on milkbarstore.com via code that will be emailed to you upon completion of the survey.
WAIVER AND RELEASE
You acknowledge that you are fully aware that participation in the product test as a volunteer may expose you to a risk of personal injury (for example, potential allergic reaction) and you assume this risk by participating in the product test. You hereby release Milk Bar and its officers, directors, managers, members, employees, agents, consultants and independent contractors (collectively, “Released Parties”) from any liability whatsoever for any and all personal injuries and other claims arising from your participation in the survey and product test, including claims that are known or unknown. You agree that you will not now or at any time in the future, directly or indirectly, pursue any legal action against the Released Parties for any claims arising out of or relating to your participation in the survey and/or product test. This provision is binding on you, your spouse, your children, legal representatives, heirs, successors and assigns.
This document constitutes the entire agreement as to the subject matter hereof, and there are no understandings or agreements between you and Milk Bar relating to this product survey other than those expressed herein. This document shall be governed by and construed in accordance with the laws of the State of New York. You agree that the exclusive venue for the litigation of any claim arising out of these Terms and Conditions or your participation in the focus group will be the state and federal courts located in New York County, New York.
